Issue:
A real estate developer was hired by a property owner to transform his vacant tract of land into a housing development, building the homes and selling them to interested buyers. Building and sales proceeded as planned until the property owner claimed the developer had failed to adhere to the terms of the contract and decided to terminate the contract so that he could build and sell the remaining houses himself.
Resolution:
A lawsuit ensued and the court ruled that the contract had been improperly terminated. David Anderson was hired to calculate the economic damages suffered by the real estate developer as a result of the contract termination. Following an exhaustive analysis of the contract provisions and the housing development and sales projections, David testified in court as an economic damages expert witness. His assessment and determination of damages was accepted in full by the court and the entire amount was awarded to the real estate developer.
